Rules of European club of estate agencies

1. European club of estate agencies (mentioned as EKRK)

Its open coalition of individual estate agencies (RK), which decided to cooperate on the market of real estates according to the rules, which they made up.

  • Members of EKRK are prominent estate agencies from the regions, which closely cooperate with other members of EKRK in CR and abroad. CR is devided into 14 regional clubs:
    - Praha and sur.  (A-EKRK)
    - Středočeský  (C-EKRK)
    - Budějovický  (CB-EKRK)
    - Plzeňský  (PL-EKRK)
    - Karlovarský  (KV-EKRK)
    - Ústecký  (ÚS-EKRK)
    - Liberecký  (LB-EKRK)
    - Královéhradecký  (KH-EKRK)
    - Pardubický  (PR-EKRK)
    - Jihlavský  (JI-EKRK)
    - Brněnský  (BR-EKRK)
    - Olomoucký  (OL-EKRK)
    - Ostravský  (OV-EKRK)
    - Zlínský  (ZL-EKRK)
  • The member of EKRK can become an estate agency (or more according to the meaning and range of the market) in one current region of CR. Numbers of agencies approve representatives of particular regions. By this establishment is created and guaranteed exclusiveness of membership for those estate agencies.
  • The criteria of acceptance of the estate agency is steady commercial position, with permanent staff (employees) and technical equipment and minimum ten-year reality experience, abiding with the rules and ethic principles of carring out business (under extra circumstances can be given an exception).
  • Establishment of items 1 ii, iii does not restrict possibility of one RK to participate on project of EKRK in several regions, as long as they are not already represented by other RK, active (and functional) establishment 1F.
  • Membership in EKRK does not restrict activities of RK in other regions in case, that this region is not already occupied by other member of EKRK. Every RK has the right to set up its branch office in any place in CR or abroad. This RK or branch, even in case, that will present itself totally separately and that region will not be occupied yet, has not preferential right for the membership in EKRK.
  • The main target and philosophy of EKRK is to established in individual regions professional RK as representative of EKRK, which will propagate, represent and share the financial part of quality professional cooperation of all members of EKRK. Because in exist region has not yet any competition from EKRK. Incase of more members in region as for example Praha, Brno, Ostrava etc., which were approved and accepted, these members mutually cooperate, whereby pushing forward the sale of theirs orders and increase of advertising of their real estates. And just this is philosophy of EKRK including professionalization of all memebers, common edition of presentation and advertising material of type REAL ESTATES etc. And sequential making use of all advantages and perks which are connected with this activity.

2. Membership in EKRK

In regard of respect to exceptionality of the whole project, when on the activity of individual RK depend the functionality of the whole system, is necessary to provide to memebers of EKRK maximum possible exclusiveness.

  • Selection of RK in particular regions in CR isin competency of members from individual regions of EKRK. Election should respect already functional business relation among the partners in neighbouring regions and subsequently communicate and cooperate in states of EU and as well as out of EU.
  • The member of EKRK will become the chosen RK by signature of "Rules of EKRK". By this act become signed documents obligatory for RK.
  • Membership in EKRK is not time limited and there is no legal claim to this membership.
  • Membership can be finished from the side of RK by giving the notice.
  • Membership can be also finished by decision of regional representatives of EKRK. As a result can be among others breaking the rules of EKRK in relation to other member of the club.
  • Termination proposal of membership of some RK can give any member of EKRK through president or representative of the region. With this act has to agree absolute majority of members from particular regions.
  • Membership cannot expire from the impulse of editor and producer of REAL ESTATES in case, that contracting partner keeps the rules given by contract with editor and producer (amendment to the rules).
  • Membership in EKRK expire to contracting partner immediately in case that he participates without any approvel of other members of the club in competitive projects. By this regulation the members of EKRK protect already established know-how.
  • In case that member of EKRK breaks the rules and begins to set up branches or representation in regions already occupied by regular member of EKRK, representatives of existing region will decide about the exclusion or other repair.

3. Rights and obligations of board of directors of EKRK

At the head of EKRK is president. In respect of the extent of territory of CR are for individual regions, elected representatives of regions, and from these representatives is elected board of directors and manager of EKRK.

Representatives of regions are elected at regional meeting of EKRK and this takes place once in five years, if its not agreed in different way. At elections is set up majority rule. If does not come to the election (major), the president of EKRK has the right to decide.
No other functions are settled.

Obligation of board of directors of EKRK is:

  • communicate in the name of the EKRK with editor and producer REAL ESTATES, banks, developers, with public, etc., passing reminders and impulses destined to the increase of the quality of the EKRK activity
  • call and conduct meetings of regional clubs EKRK and this with recommended period min. 3 months
  • in case of resign of some of the partners to provide quality replacement by other RK from the appropriate region
  • select in particular vacant regions suitable partners for the membership in EKRK and subsequently for the edition of REAL ESTATES (with respect to already existing business relations)
  • propose cancellation from membership in EKRK to the partner, who demonstrably broke rules of EKRK (to withdraw membership is necessary to have the absolute majority of votes of members of region
  • in case of problems with edition and production of print to search out new editor and productor (extreme increase of price, deterioration in quality etc.)

The activity of the presidium of the EKRK is not entitled to remuneration. If incurred costs (lease of the hall intended for meeting, travel costs etc.) extremly burden members of the presidium of the EKRK, they can solve the whole matter at the meeting of the board of directors.

4. General rules of the business with real estates in EKRK

Because each of RK which participates already has its own existing system of work, there is no aim to change or unify this system.

Members of EKRK are obliged to keep the following basic regulations:

  • RK is not obliged to present together all real estates from its offer. It depends on the deliberation of appropriate manager, who offers real estate for mutual commerce.
  • Real estate which is published by RK and offered for cooperation in REAL ESTATES or at www.ekrk.com, has to be treated by an exclusive mediatory contract. In case of purchase or reservation, real estate has to be subsequently marked. In this case is necessary that contidions of contract abide by general rules.
  • Validity of the mediatory contract should expire minimum one month after the edition of appropriate REAL ESTATES.
  • In case of mutual carring out of purchase, the office which enterted the real estate into the sale is obliged to officially ensure the sale (documentation, contracts, reports, etc.).
  • The basic division of commision among the members of EKRK is determinated by the rate 30% - 70%, eventually 50% - 50%, but its preferable, that each of RK makes contract with its own client (buyer or saller)
  • The office which carried out the sale is obliged to pay out the commission and this without any appeal.
  • Costs connected with the sale are not evaluated and accounted because of the wrong declaration of documents and demonstration.
  • In case of any inconsistence in paying out the commissions, is possible to solve the whole matter through the board of directors of EKRK.

Its possible to change these rules during the communication among the individual RK and this is valid also for particular business transactions. Board of directors of EKRK does not possess authority to interfere to these relations however has right to check the keeping of agreed conditions.
